This Privacy Policy describes how Simon Medical, Inc. (“Simon Medical,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit our website, create an account, place an order, contact us, request a repair or exchange, subscribe to our newsletter, or otherwise interact with us. It also describes the privacy rights available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), and our practices under the California Online Privacy Protection Act (“CalOPPA”).

1. Scope of This Policy

This Privacy Policy applies to personal information we collect through our website, by email or telephone, and in the course of selling, repairing, and exchanging medical and surgical equipment. Service providers that process information for us may also publish their own privacy notices. This policy does not apply to an unrelated third party’s independent collection on a website or service that it operates.

2. Information We Collect

We collect the following categories of personal information, depending on how you interact with us:

  • Identifiers. Name, billing and shipping address, email address, telephone number, account username, and similar identifiers.
  • Account information. Login credentials, order history, saved addresses, and account preferences.
  • Order and transaction information. Products purchased, quotations requested, repair and exchange details, and records of communications related to your orders.
  • Payment information. Payment card and billing details, which are collected and processed by our third-party payment processor. We do not store full payment card numbers on our systems.
  • Commercial information. Records of products or services purchased, considered, or obtained, and purchasing histories or tendencies.
  • Internet and usage information. IP address, browser type, device identifiers, pages viewed, referring pages, and other activity collected through cookies and similar technologies.
  • Advertising and conversion information. Advertising identifiers, consent choices, campaign and referral information, and purchase events used to understand whether an advertisement led to a transaction. Where Enhanced Conversions is enabled and you permit marketing measurement, your email address may be normalized, hashed with SHA-256, and disclosed to Google for matching and conversion measurement.
  • Communications. Information you provide through our contact form, repair and exchange requests, newsletter sign-ups, and other correspondence.

We generally do not collect sensitive personal information as defined by the CCPA. If you choose to provide such information to us, we use it only for the purposes for which it was provided.

Do not submit patient information. Our public website forms and ordinary email channels are not intended to receive protected health information or patient-identifying information. Please contact us before transmitting any such information so that we can determine whether an appropriate secure method and written agreement are required.

3. How We Use Your Information

We use personal information for the following business purposes:

  • To process, fulfill, and ship orders, and to provide repair and exchange services
  • To create and maintain customer accounts
  • To process payments and prevent fraudulent transactions
  • To respond to inquiries, quotation requests, and customer service requests
  • To send order confirmations, shipping notifications, and other transactional messages
  • To send newsletters and marketing communications where you have requested them
  • To measure website usage and advertising performance in accordance with your privacy choices

  • To comply with legal, regulatory, tax, and recordkeeping obligations

4. How We Disclose Your Information

We do not sell your personal information for money. We may disclose personal information to the following categories of recipients in order to operate our business:

  • Payment processors, to process and verify payments and to prevent fraud.
  • Shipping carriers, including FedEx, to deliver orders and repair or exchange units.
  • Email and marketing service providers, to deliver transactional and newsletter messages.
  • Analytics and advertising providers, including Google, to measure website usage, advertising performance, and purchase conversions in accordance with your privacy choices. This may include a SHA-256 hash derived from your email address for Google’s Enhanced Conversions matching service. Because the hash is deterministic and is used for matching, we treat it as personal data and do not describe it as anonymous.
  • Service providers, such as website hosting, consent management, analytics, and technology vendors that perform services on our behalf.
  • Legal and regulatory authorities, where disclosure is required by law, legal process, or to protect our rights, property, or safety, or that of others.
  • Business successors, in connection with a merger, acquisition, financing, or sale of assets.

Service providers are permitted to use personal information only as necessary to perform services for us and are contractually required to protect it.

5. Cookies and Tracking Technologies

Our website uses necessary cookies to operate the shopping cart, account login, security features, and your privacy preferences. If analytics or advertising technologies such as Google Analytics or Google Ads are enabled, they may be used only in accordance with your privacy choices to understand website usage and measure advertising performance. You can accept, reject, or change non-essential cookie categories at any time by selecting Cookie Settings in the website footer. Rejecting non-essential cookies does not prevent you from shopping, but some optional features or measurement may be unavailable.

We use a consent management platform to record and communicate your choices to compatible services. We also treat supported browser-based opt-out preference signals, including Global Privacy Control, as an opt-out from sale or sharing for that browser where required by applicable law. Because there is no common standard for other “Do Not Track” signals, we do not currently respond to signals other than supported legally recognized opt-out preference signals.

6. Do Not Sell or Share My Personal Information

Simon Medical does not sell your personal information for money. Some analytics or advertising activity may be considered “sharing” or a “sale” under the CCPA’s broad definitions. You may opt out of non-essential advertising and any sale or sharing associated with those technologies by selecting Cookie Settings in the footer and rejecting marketing cookies. You may also use the contact methods in the “How to Exercise Your Rights” section. We will not discriminate against you for making a privacy choice.

7. Your California Privacy Rights

If you are a California resident, you have the following rights under the CCPA, subject to certain exceptions:

  • Right to know and access. You may request the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we disclose it.
  • Right to delete. You may request that we delete personal information we collected from you.
  • Right to correct. You may request that we correct inaccurate personal information we maintain about you.
  • Right to opt out of sale or sharing. You may direct us not to sell or share your personal information.
  • Right to limit use of sensitive personal information. Where we use sensitive personal information beyond permitted purposes, you may direct us to limit that use.
  • Right to non-discrimination. We will not discriminate against you for exercising any of your privacy rights.

You, or an authorized agent acting on your behalf, may submit a request to exercise your rights by contacting us:

For your protection, we may need to verify your identity before processing your request, which may require you to confirm information we already maintain about you. We will respond to verifiable consumer requests within the timeframes required by law. You may use an authorized agent to submit a request, in which case we may require written authorization and verification of identity.

9. California Shine the Light

California Civil Code Section 1798.83 permits California residents to request information regarding our disclosure of personal information to third parties for those parties’ direct marketing purposes. Simon Medical does not share personal information with third parties for their own direct marketing purposes. You may direct any Shine the Light request to the contact information provided in this Privacy Policy.

10. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide our products and services, maintain account and transaction records, resolve disputes, and comply with our legal, tax, accounting, and regulatory obligations. When personal information is no longer required, we take reasonable steps to securely delete or de-identify it.

11. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

12. Children’s Privacy

Our website and services are intended for businesses and healthcare professionals and are not directed to children. We do not knowingly collect personal information from individuals under 16 years of age. If we learn that we have collected personal information from a child under 16, we will delete that information. If you believe a child has provided us with personal information, please contact us.

13. Third-Party Links

Our website may contain links to third-party websites, products, or services that are not operated by us. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party site you visit.
